Анотація:
Стаття присвячена дослідженню суб’єктного складу систем державного експортного контролю за товарами військового призначення та подвійного використання в країнах Європейського Союзу. На прикладі Австрії, Німеччини, Португалії, Франції, Іспанії, Італії та Бельгії проаналізовано організаційно-правові особливості функціонування національних систем контролю, зокрема їхню залежність від форми державного правління та устрою. Визначено ключові інституції, їхні повноваження у сфері ліцензування, контролю за дотриманням санкцій, взаємодії з міжнародними режимами експортного контролю та європейськими структурами. Окрему увагу приділено децентралізації функцій у федеративних державах, створенню міжвідомчих комісій у ядерних країнах та гармонізації національного законодавства з правом ЄС. Результати дослідження можуть бути використані для удосконалення суб’єктної структури системи державного експортного контролю України та налагодження ефективної співпраці з європейськими партнерами.

The article is devoted to the study of the subject composition of the state export control systems for military and dual-use goods in the countries of the European Union. Using the example of Austria, Germany, Portugal, France, Spain, Italy and Belgium, the organizational and legal features of the functioning of national control systems are analyzed, in particular their dependence on the form of state government and structure. Key institutions are identified, their powers in the field of licensing, control over compliance with sanctions, interaction with international export control regimes and European structures. Special attention is paid to the decentralization of functions in federal states, the creation of interdepartmental commissions in nuclear countries and the harmonization of national legislation with EU law. The results of the study can be used to improve the subject structure of the state export control system of Ukraine and establish effective cooperation with European partners.
